1. The Service

ecomspy ("Service") is an AI-powered ecommerce toolkit operated by CreatPix Infotech LLP ("Company", "we", "us"). The Service provides 23 AI-generated analysis and content tools for ecommerce stores, accessible at ecomspy.io. ecomspy is a product of CreatPix, a certified Shopify Plus development agency (creatpix.com).

2. Accounts

• You are responsible for keeping your password secure and for all activity under your account.
• Notify us immediately at [email protected] if you suspect unauthorised access.
• We may suspend or terminate accounts that violate these Terms without prior notice.
• You may not share account credentials or create accounts for others without their knowledge.
• One account per person. Creating multiple accounts to circumvent usage limits is prohibited.

3. Acceptable Use

You agree not to:

• Use the Service to generate spam, misleading content, or material that violates any law
• Attempt to scrape, reverse-engineer, or extract the underlying AI prompts or models
• Automate requests beyond normal human usage patterns or circumvent usage limits
• Submit content that infringes intellectual property rights of third parties
• Use the Service to analyse sites you do not own or have no authorisation to analyse
• Resell or white-label outputs from ecomspy without our written consent
• Attempt to gain unauthorised access to our systems, databases, or other users' accounts

4. AI-Generated Content Disclaimer

AI outputs may occasionally be inaccurate, incomplete, or outdated. The quality of analysis depends on the accuracy of information you provide and the URL you submit.

5. Intellectual Property

Our IP: ecomspy, its tools, interface, prompts, and underlying technology are owned by CreatPix Infotech LLP. You may not copy, reproduce, or create derivative works without written permission.

Your content: You retain ownership of any content you submit (URLs, store data). By submitting content, you grant us a limited licence to process it solely for the purpose of providing the Service.

Generated outputs: Subject to these Terms, you own the outputs generated for your account and may use them commercially.

6. Plans & Pricing

• Free plan: 5 runs per month across all 23 tools combined. No credit card required.
• Pro plan: $25/month for unlimited runs across all 23 tools, plus report saving, activity history, and PDF/PPTX export.
• Manual billing — no auto-renewal: The Pro plan is not automatically renewed. Each month you choose to continue, you manually initiate the payment. You will never be charged without your explicit action.
• Pro access is active for 30 days from the date of each payment. If you do not make a payment, your account reverts to the Free plan automatically — no cancellation step required.
• All Pro plan payments are non-refundable. See our Refund Policy for full details.
• We reserve the right to adjust pricing with at least 30 days' notice.

7. Fair Use

Usage is subject to fair-use policies to ensure platform availability for all users. We reserve the right to apply rate limits at any time. Abuse of the Service (automated scraping, bulk generation, bot usage, or circumventing usage limits) will result in immediate account suspension without refund.

8. Availability & Uptime

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or emergency changes that temporarily make the Service unavailable. We will not be liable for losses caused by downtime.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability to you for any claim arising from use of the Service shall not exceed the total fees paid by you in the 3 months preceding the claim. For free plan users, this amount is USD $0.

10. Indemnification

You agree to indemnify and hold harmless CreatPix Infotech LLP and its officers, employees, and partners from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

You may delete your account at any time via your account settings. Since Pro access is not auto-renewed, deleting your account simply stops future manual payments — no additional step is needed. We may terminate or suspend your account immediately if you breach these Terms. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (IP, limitation of liability, indemnification) will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after changes are effective constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India. Nothing in this clause limits statutory consumer rights you may have under the laws of your country of residence.
